Charterers have the option to load Nickel Ore which is listed in Appendix 1
Group A of the "Code of Safe Practice for Solid Bulk Cargoes (BC Code)",
provided Charterers observe at the time of lading all existing laws, rules,
regulations and directions of the competent Authorities and Classification
Society as well as IMO and relevant national regulations, if any.
Charterers have the option to carry this Nickel Ore, but maximum two voyages
per year, not consecutive.
Before loading nickel ore Charterers to supply Vessel with Shipper's
certificated of TML, declaration of characteristics of the cargo and
moisture content evidencing cargo compliance with IMO regulations.
Master/Owners have the right to reject cargo which he/they deems unsafe for
carriage.
Charterers guarantee cargo moisture content must be lower than TML.
The stowage to be within Vessel's strength.
A competent independent surveyor to be jointly appointed to ascertain
properties of the cargo and specifically its compliance with the IMO
prescribed TML (Transportable Moisture Limit), and to ensure cargo is safe
for carriage.
Charterers to allow Owners to appoint P&I surveyor or independent surveyor
(cost to be for Charterers' account) to supervise loading, stowing,
measuring of TML and other characteristics of the cargo.
After loading, cargo must be properly trimmed at Charterers' time and
expense to surveyors' and Master's satisfaction.
The limited cargo are not permitted to be carried continuously and not to be
the last cargo prior to redelivery.
